1. Agreement to Terms

By booking or participating in any charter, tour, or service provided by San Diego Boat Tours, you agree to these Terms of Service. These terms apply to all passengers in your party.

2. Services

San Diego Boat Tours provides private charters, sightseeing tours, and custom maritime experiences on San Diego Bay and surrounding coastal waters. All services are subject to availability, weather conditions, and the professional judgment of the vessel’s captain.

3. Reservations and Payment

    • A deposit or full payment is required to secure a reservation.
    • Reservations are not confirmed until payment is received.
    • Pricing may vary based on vessel, duration, group size, and requested services.
    • The booking party is responsible for all guests in their group.

4. Cancellation and Rescheduling

    • Cancellation terms are provided at the time of booking and may vary by charter.
    • Weather and sea conditions are determined solely by the captain.
    • If a charter is canceled by San Diego Boat Tours due to safety concerns, a reschedule or refund will be offered.
    • No-shows or late arrivals may result in forfeiture of payment.

5. Captain’s Authority

The captain has full authority over all safety and operational decisions, including but not limited to departure timing, route, passenger conduct, and cancellation due to unsafe conditions. All passengers must follow crew instructions at all times.

6. Passenger Responsibilities

    • Passengers must act in a safe and respectful manner.
    • Disruptive, unsafe, or illegal behavior is strictly prohibited.
    • San Diego Boat Tours reserves the right to refuse boarding or terminate a charter without refund if safety rules are violated.
    • Children must be supervised at all times.

7. Alcohol and Prohibited Items

    • Alcohol may be permitted on certain charters; however, excessive intoxication is not allowed.
    • Illegal drugs and prohibited substances are strictly forbidden.
    • The captain may refuse service or terminate a charter if safety is compromised.

8. Assumption of Risk

Participation in boating activities involves inherent risks, including but not limited to vessel movement, changing weather conditions, slippery surfaces, and water-related hazards. By participating, you voluntarily assume all risks associated with these activities.

9. Medical and Fitness Responsibility

Passengers are responsible for determining their own physical fitness for participation. San Diego Boat Tours is not responsible for medical conditions, seasickness, or injuries resulting from pre-existing conditions.

10. Limitation of Liability

To the fullest extent permitted by law, San Diego Boat Tours shall not be liable for:

    • Personal injury, illness, or death
    • Loss or damage to personal property
    • Indirect, incidental, or consequential damages

All services are provided “as is” without warranties of any kind, express or implied.

11. Indemnification

You agree to indemnify and hold harmless San Diego Boat Tours, its owners, crew, and affiliates from any claims, damages, or liabilities arising from your participation or violation of these Terms.

12. Damage and Cleaning Fees

The booking party is responsible for any damage caused to the vessel or equipment. Additional cleaning or repair fees may be charged as necessary.

13. Personal Property

Passengers are responsible for their personal belongings. San Diego Boat Tours is not liable for lost, stolen, or damaged items.

14. No Guarantee of Conditions or Experiences

San Diego Boat Tours does not guarantee specific weather conditions, wildlife sightings, water visibility, or other environmental factors.

15. Media Release

Photos or videos may be taken during charters for promotional purposes. By participating, you grant permission for your likeness to be used unless written notice is provided prior to the charter.

16. Force Majeure

San Diego Boat Tours is not liable for cancellations or delays caused by events beyond its control, including weather, mechanical issues, harbor restrictions, government actions, or emergencies.

17. Governing Law

These Terms shall be governed by the laws of the State of California. Any disputes shall be resolved in San Diego County, California.

18. Changes to Terms

San Diego Boat Tours reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of any changes.
